2. Price
The prices indicated for the products available on the Website are all inclusive of VAT (where applicable) at the current rates and do not include delivery, packaging or other charges, which will be added to any order you place.
Although we endeavour to keep prices on the website up to date, we reserve the right to change them at any time.

3. Products
All product descriptions and images on the website are provided in good faith but are for guidance only and there may be slight variations in product colour, packaging design or specifications.

The information provided to our customers is for informational purposes only and is not intended to diagnose, treat or prevent any condition or disease, nor to prescribe or replace professional advice. You should always check the ingredients of products to avoid potential allergic reactions. If you have any personal concerns, please consult your own physician or healthcare professional regarding the use of any goods, products or information received through the website before using or relying on them.

We do not accept responsibility for misuse of our products. It is the customer's responsibility to use the products with discretion and follow the advice on the label. 4. Resale of products
You agree and acknowledge that the Products are for your personal use and that you may not sell or resell any Products or Services, or samples thereof, that you purchase or receive from us. We reserve the right, with or without notice, to cancel or reduce the quantity of any order that we believe, in our sole discretion, may result in a violation of our Terms of Sale.

5. Online orders
When you place an order online, you are assisted throughout the process by simple instructions on the website. You place your order for goods on the website by clicking on the “Order” button at the end of the online ordering process.
We will send you an email confirming your purchase and providing you with the details and value of your order, which has been charged to your credit/debit card. This is not an acceptance of the order by us.
A dispatch confirmation email, including a tracking code, will then be sent when your order leaves our warehouse. Acceptance of your order and conclusion of the contract between you and us will take place when we have dispatched the products to you.

We will retain legal ownership of the Products until they are delivered to you. Legal ownership of the Products will revert to us immediately if we refund any payment you have made for the Products.

To cancel your order after it has been shipped, you must contact us at hello@idswissbotanicals.com .

If we are unable to supply you with the products you have ordered, we will cancel your order and notify you as soon as possible. We will provide you with a full refund if you have already paid for the products. This may be because (i) the product is out of stock; (ii) because we have identified an error in the price or description of the product; (iii) our inability to obtain authorisation for your payment; or (iv) because of unexpected limits on our resources which we could not reasonably foresee.

We reserve the right to reject, cancel or terminate any order at our discretion and without reason.

6. Payment
You can pay by credit/debit card. Please note that we will collect, store and use your information in accordance with our Privacy Policy on our website.

All card payments are subject to authorisation by your card issuer. If your card issuer refuses or does not authorise payment to us for any reason, whether in advance or after a payment, we will cancel your order and notify you in writing (which may include email).

All products will remain our property until we have received full payment for such products. Legal ownership of the products will revert to us immediately if we refund such payments to you.

7. Delivery of products

We will deliver the products using the delivery option you selected during the order process. Any delivery times quoted to you are indicative only. All risk in the products you order (including the risk of loss and/or damage to the products) will pass to you upon delivery. We will not be liable for any delay or failure to deliver the products if the delay or failure is caused by a third party or is wholly or partly caused by circumstances beyond our control.

If the products are returned to us by the delivery company, we will refund you for the products, but we reserve the right to retain all costs incurred in arranging delivery and return of the product.

8. Acceptance of Goods / Returns and Refunds
Upon receipt, you must inspect the goods. You will be deemed to have accepted the goods unless you notify us that you have cancelled the order and/or return the goods in accordance with the returns policy and procedure. If no such action is taken, we will not be obliged to accept any rejection of the goods at a later date. Your statutory rights are not affected.

Furthermore, the following general terms and conditions of sale apply exclusively in their version valid at the time of placing the order (hereinafter "GTC"). We do not recognize any deviating conditions on your part. You have the option of saving or printing these general terms and conditions, it being specified that both the saving and the printing of this document are your sole responsibility.
We reserve the right to supplement, modify or cancel the T&Cs at any time.

REPLACEMENT & REFUND POLICY

Our returns/replacement policy can be viewed here and forms an integral part of these terms and conditions.

BREAK

Transport damage must be reported no later than 48 hours after receipt of the goods, after which the request for free replacement will expire.

NON-RECEPTION

In the event of non-receipt of the goods, we will send you a replacement product provided that you have explicitly informed us of this in writing. You have one month to report non-receipt of your order.

REFUND

To be eligible for a refund, we must receive your returned product within 30 calendar days of your purchase. The product must be in the same condition that you received it. If your returned product is received after 30 calendar days, you will not be eligible for a refund.
After receiving your item, our team will review and process it for a refund. The money will be refunded to the original payment method you used when purchasing, unless otherwise requested.

FORCE MAJEURE

We will not have failed in our contractual obligations to the extent that performance is hindered, delayed or prevented by an act of God or force majeure. Any act or circumstance that is irresistible, external to Babylon Sciences SA , unforeseeable, inevitable, independent of our will and which cannot be controlled by the latter, despite all reasonable efforts, will be considered an act of God or force majeure.
In the event of force majeure, we will inform you within 5 days of the date on which we become aware of it. The two parties will then come together, within 10 days, unless this is impossible due to force majeure, to examine the impact of the event and agree on the terms of the agreement.
